Employer Sponsored 187 Visa

The Regional Sponsored Migration Scheme (RSMS) enables employers in regional, remote or low population growth areas of Australia to fill skilled positions on a permanent basis with non-Australian citizens where they are unable to fill a vacancy locally. These positions can be filled by applicants from overseas or who are temporarily living or working in Australia.

Under the Direct Entry Stream, the Department of Home Affairs seeks advice from Regional Certifying Bodies (RCB) where the nominated position is located, whether the employer nomination meets the following criteria:

  • there is a need for a paid employee in the nominated position within the business activities of the nominating employer;
  • the nominated position cannot be filled by an Australian citizen or Australian permanent resident who is living in the same local area as the nominated position; and
  • the terms and conditions of employment that are applicable to the nominated position will be no less favourable than the terms and conditions that are or would be provided to an Australian citizen or Australian permanent resident for performing equivalent work in the same workplace at the same location.

Direct Entry Stream

This stream is used if employers want to nominate an applicant to fill a position that is:

An occupation that is classified at skill level 1 to 3 by the Australian and New Zealand Standard Classification of Occupations (ANZSCO) full-time, ongoing and for at least two years.

Employers must seek advice from a Regional Certifying Body in relation to the position they want to fill as this is a legislative requirement for Department of Home affairs approval of a nomination. The resulting advice can be submitted before or after lodging an employer nomination application online.

RSMS Assessment Process

Regional Development Australia Murray (RDAM) as a Regional Certifying Body (RCB) is required to provide an assessment for the Regional Sponsored Migration Scheme (RSMS) visa under the Direct Entry Stream. RDA Murray will assess the application against the three requirements under the Migration Regulations 5.19(4) as outlined on Department of Home Affairs Form 1404.

Download the  RSMS Assessment Document Checklist  and submit this with your application and the listed documents.

RDA Murray may request additional information where necessary to complete its assessment. On finalisation of the assessment, the Department of Home Affairs Form 1404 will be then returned to the applicant by email to the nominated email address. The nomination application should then be submitted to Department of Home affairs (if not already done so).

Where the assessment is that the nomination does not satisfy the requirements outlined on Department of Home affairs Form 1404, RDA Murray will provide this advice to Department of Home Affairs . This advice will be considered by Department of Home Affairs case officer when he/she assesses the application. Applicants will have a further opportunity at that time to make a further submission to Department of Home affairs on this matter.

Please note: Making an application under RSMS does not guarantee a positive outcome. It is the RCB's discretion whether to approve the application or not
